1. Introduction & Acceptance

Community Market Hub Job Board (“CMH”, “we”, “us”, “our”) is a South-African online marketplace that connects employers with jobseekers. By accessing or using jobs.communitymarkethub.co.za (the “Site”) you (“you”, “your”, “user”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.

2. User Accounts & Registration

2.1 Two Account Types

  • Employer Account – for companies, NGOs, sole-proprietors and recruiters posting jobs.
  • Jobseeker Account – for individuals uploading CVs and/or applying for jobs.

2.2 Registration

  • You must be 18 or older and legally capable of entering into contracts.
  • Provide accurate, complete information and keep it updated.
  • One account per user (we may verify ID numbers or company registration numbers).

2.3 Security

  • Keep your password confidential; you are fully responsible for activity under your account.
  • Notify us immediately at admin@communitymarkethub.co.za if your account is compromised.

3. Employer Terms

3.1 Job Posting Standards

  • Jobs must be genuine, lawful and located in South Africa.
  • No discrimination based on race, gender, pregnancy, marital status, ethnic origin, age, disability, religion, sexual orientation or any other protected characteristic (EEA & B-BBEE compliance expected).
  • Write adverts in clear, honest language; include salary range or “Market-related”.
  • Remove the advert once the role is filled or after 60 days (whichever is sooner).

3.2 Pricing (MVP Phase)

  • Standard job listings are currently FREE.
  • Future “Boosted” or “Premium” listings will display pricing before you post.
  • No payment details are required for free listings.

3.3 Employer Responsibilities

  • You are the data controller of applications you receive; process them in line with POPIA.
  • Respond to applicants within a reasonable time.
  • Do not contact applicants for unrelated products or services.

3.4 Prohibited Content

  • MLM schemes, franchise fees, unpaid internships contrary to SA labour law, or any content that requires an up-front payment from jobseekers.
  • Jobs that would require the worker to violate immigration, tax or POPIA regulations.

4. Jobseeker Terms

4.1 CV Accuracy

  • You warrant that all information submitted (CV, cover letter, qualifications) is true, current and not misleading.
  • Misrepresentation may lead to account closure and referral to relevant authorities.

4.2 Application Process

  • Clicking “Apply” sends your uploaded CV and basic profile data to the employer.
  • We do not guarantee interviews or feedback; that relationship is between you and the employer.

4.3 Your Rights

  • Download or delete your CV at any time via your dashboard.
  • Opt-out of marketing emails by clicking “Unsubscribe” or emailing us.

4.4 Prohibitions

  • Do not apply for roles for which you are unqualified with the intent to harvest employer contact details.
  • Do not upload viruses, executable files or links to harmful sites.

5. Content & Intellectual Property

You retain ownership of any text, logos, images or documents you post. By posting you grant CMH a non-exclusive, royalty-free, worldwide licence to host, display and reproduce that content solely for the operation and promotion of the Site. You may remove your content at any time by deleting the job or your account; the licence ends once the content is fully purged from our servers (typically within 30 days).

6. Privacy & Data Protection (POPIA)

We comply fully with the Protection of Personal Information Act 4 of 2013 (“POPIA”). Our Privacy Policy explains:

  • What personal info we collect (CV data, company registration numbers, contact details, log data).
  • Why we collect it (matching jobs, improving security, invoicing when paid features launch).
  • Who we share it with (employers if you apply; service providers under confidentiality agreements).
  • How long we keep it (CVs: until you delete them or 2 yrs after last login; job posts: 60 days then archived).

Your POPIA rights: access, correction, deletion, objection, restriction of processing. To exercise any right email admin@communitymarkethub.co.za. We will respond within 21 days.

7. Fees & Payments

  • Standard listings are free during the MVP phase.
  • Premium or Boosted listings will be clearly marked with pricing before you confirm purchase.
  • All fees are quoted in South African Rand (ZAR) and include VAT where applicable.
  • No refunds for paid listings that have already gone live; we may offer credit at our discretion for technical failures on our side.

8. Prohibited Activities

You may NOT:
  • Scrape, spider, data-mine or copy profiles or job adverts without our written consent.
  • Post false or misleading information or impersonate any person or entity.
  • Use the Site to harvest e-mail addresses for unsolicited marketing (“spam”).
  • Introduce viruses, trojans, worms or any other malicious code.
  • Engage in any conduct that violates South African law or the rights of other users.

9. Limitation of Liability

CMH is a technology platform; we are not an employer, recruitment agency or labour broker. We do not screen every job or CV. You enter into employment relationships at your own risk.

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special or consequential damages (including lost profits or data).
  • Our total aggregate liability to any user for all claims arising out of use of the Site shall not exceed ZAR 1,000 or the total amount you paid CMH in the 12 months preceding the claim, whichever is greater.
  • You indemnify us against all claims, damages or expenses arising from your breach of these Terms or your misuse of the Site.

10. Dispute Resolution

  • These Terms are governed by South African law.
  • Raise any complaint with our support team first; we aim to resolve within 10 business days.
  • If unresolved, either party may demand mediation under the rules of the Arbitration Foundation of South Africa (AFSA). Mediation will be held in Gauteng, South Africa, in English.
  • If mediation fails, the dispute will move to AFSA arbitration; the arbitrator’s decision will be final and binding.

11. Termination

By You

Delete your account via Dashboard → Settings → “Close Account”. Your personal data will be deleted within 30 days unless we are legally required to keep it.

By Us

We may suspend or terminate accounts, remove content or limit access if we reasonably believe you have violated these Terms, POPIA, or any law. Where possible we will give notice and a 5-business-day window to remedy.

12. Changes to Terms

We may update these Terms from time to time. We will post the new version here and, if the changes are material, we will email you or display a prominent notice on the Site. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.
